The
Law
If
you own your garden you may think that you can
do what you like in it. That is no the case. There
are restrictions both private and statutory e.g.
your deeds might say that you must keep the front
garden open plan, and not erect boundaries of
any kind be they garden fences, hedges or walls.
Planning laws may say that you cannot use the
garden for particular purposes; youmay have an
obligation even towards trespassers, let alone
lawful visitors.A
tree in your garden may the subject of a Tree
Preservation Order preventing you from even gardening
as you might wish.
What
side of garden fences is mine?
If
the fence in your garden is what is called a "party"
fence, then you will own it jointly with your
neighbour.
More
precisely, try and imagine a vertical line severing
the fence in half down the middle — you
will own the half which is on your side of the
imaginary division and your neighbour will own
the half on his/her side.
On
the other hand, your garden fences may belong
exclusively to you or exclusively to your neighbour.
In
this case, the whole fence will belong to whichever
of the two of you owns it.
The
title deeds to your home will usually indicate
who owns any garden fences.
How
to erect a garden fence
If you are fitting ready made panels, measure
the internal distance between each post or support
to match the external width of each fence. You
will need to set the posts into concrete or better
still, set metal supports in first then bolt the
posts onto the support when set.
